General Terms of Sale
All the orders for products accepted by HEGARDT, S.L (HEGARDT from here on) are in accordance with the following general conditions of sale that will form part of the contract of sale. The acceptance of products implies acceptance of these general conditions of sale and those specific ones for each commercial operation, even in the case of contrary clauses included in their own general conditions of purchase.
A - PRICES AND PAYMENTS
All prices displayed on our website HEGARDT include VAT.
All invoices and delivery notes are payable to the date shown therein. Payment must be made by the means indicated in the order and in euros.
In the case of payment by account or bank transfer, the buyer must use the following data indicating the order number and the name:

B - AVAILABILITY OF PRODUCTS
Shipment and delivery terms shall be computed as from the date of acceptance of the order and are merely indicative. The Purchaser will not be entitled to any damages in the event of delay in delivery.
Any internal causes attributable to the Seller that may involve a shutdown, suspension or a temporary reduction in the Seller's production will entitle the Seller to an extension equivalent to the time of its duration.
C - PROPERTY AND RISK
The Seller reserves the full ownership of the goods sold until full and effective payment by the Purchaser of the price and amounts invoiced.
D - COMPLAINTS
D.1 - Only the complaints for defects in the goods (including the ones incurred during the transportation) received via e-mail, letter or fax will be accepted. The deadline for complaints will be 24 hours from the arrival of the goods at the destination indicated by the Purchaser, forcing this one to a proper analysis prior to its use.
In the case that some merchandise may be considered as defective, the buyer shall only have right to have this merchandise replaced or to an optional termination of the operation by HEGARDT , excluding any other type of compensation.
Any litigation, regardless of its nature, arising from the present sale, its fulfilment, execution and interpretation, shall be the exclusive jurisdiction of the Courts of the Seller’s registered offices, i.e., the city of Miranda de Ebro.
F - SHIPPING
F1 - Shipping costs will vary depending on the weight and volume of the products purchased. You can know exactly the shipping costs for your order directly from our website before confirming your order.
F.2 - Goods are considered delivered and placed at disposal of the buyer at the time of departure from our factory, always travelling by account and risk of the buyer even having being sent postage prepaid and considered only as valid weights and measures the ones reported in the aforementioned time.
G - DELIVERY TIMES
G.1 - In the case of multiple product orders the firm will proceed to perform a single one when all the materials are available, except in the event that the customer expresses otherwise, with a consequent increase in the costs of shipping.
G.2 - For those products that are not in stock, the purchaser will let the buyer know by e-mail or phone call, the approximate delivery time the manufacturer or supplier has communicated to the purchaser, and will keep the buyer informed of any changes that may arise.
H - RETURNS AND WARRANTY
H.1 - Our main guarantee is the total satisfaction of the customer with our products, so if once received, it does not meet your expectations or it has been simply made a mistake in buying, you have 7 days to make the return. In these cases, HEGARDT will return the amount of the purchase with the exception of shipping charges. To be able to return, it will be required that both the product and its packaging are in perfect condition. HEGARDT reserves the right to accept those returns that do not comply with this condition.
H.2 - In case the shipment does not arrive in perfect condition or that a mistake has been by HEGARDT, the customer is entitled to request that it is forwarded you the product at no additional cost on the other hand, once the product has been returned to our factory and the incidence has been found. In the case that the merchandise has been damaged during transport, customer must notify this situation to HEGARDT before natural 24 hours after its receipt. In this case, HEGARDT shall initiate the procedure of complaining to the transportation company to replace goods damaged without additional charge for the customer.
H.3 – If you wish to return a product purchased in HEGARDT you must notify it previously by e-mail indicating the following details:
- Order number, date, name, email and address they were purchased with.
- Purchased products, including the price.
- Reason for the return.
H.4 - Once analysed your request, the necessary instructions to process the return will be sent by email. Once received and checked the condition of the product, the corresponding payment will be made.
H.5 - Manufacturing defects or malfunction of the products are covered by the manufacturer's warranty. However, HEGARDT will facilitate and accelerate the handling of this warranty and in cases that can be as far as possible, HEGARDT will proceed to replace them without having to wait for the response from the manufacturer or supplier.
H.6 - The cost of shipping to our facilities produced by possible procedures for dealing with guarantee of our products shall be borne by the customer. Shipping costs to the client of the possible changes of products by processing of warranty shall be borne by HEGARDT.
I - PRIVACY AND CONFIDENTIALITY POLICY
I.1 - HEGARDT informs users about its personal data protection policy so that users voluntarily determine the fact of facilitating those who may require them. HEGARDT reserves the right to modify the present policy to adapt it to new legislation or jurisprudence as well as industry practice. In such cases it will be announced on this website all the changes with reasonable notice before their implementation in practice.
I.2 - In accordance with the provisions of article 5 of the Organic Law 15/1999, of December 13, of protection of Personal character data, we inform you that personal data collected will be processed automatically and incorporated into the relevant files and databases of HEGARDT, being used only for its internal use. Except in fields where it is indicated otherwise, the answers to the questions about personal data are voluntary, while the lack of reply implies a decline in the quality or quantity of the corresponding services, unless it is otherwise noted.
I.3 - The user guarantees that the personal data provided to HEGARDT are truthful and is responsible for communicating any changes in them.
I.4 - The collection and processing of personal data intends to maintain the contract any relationship established with HEGARDT, management, administration, provision, extension and improvement of services where the user decides to subscribe, register, or use the adequacy of these services to their preferences and tastes, to the study of the use of the services, the design of new services related, the sending of updates, by traditional and electronic and technical means, operative and commercial information about products and services offered by HEGARDT, currently and in the future.
